New victim, ?additional charges in Kilgore case

Four new felony charges were filed this week against Dwayn Kilgore, three of them involving an additional minor victim whose case was added in the discovery process by the county prosecutor.|

For the third time Paul Dwayne Kilgore of Sonoma came to the Sonoma County Courthouse to enter his pleas in the charges against him for sexual assault of a minor, and for the third time his public defender sought and gained a continuance that sent him back to Sonoma County Jail for at least another week.

The reason was that four new felony charges were filed this week against Kilgore, three of them involving an additional minor victim whose case was added in the discovery process by the county prosecutor.

Kilgore, 68, was arrested in September on three charges stemming from witnesses who reported inappropriate behavior between the former Boys & Girls Clubs of Sonoma Valley athletics director and two boys at the Parkpoint Health Club in Healdsburg.

In Judge Robert M. LaForge’s courtroom on Thursday, Oct. 27, Kilgore consulted with public defender Lynette Brown before the judge entered. When the case was called Brown asked for a continuance in light of new charges that were being filed by the prosecutor’s office.

The new charges refer to a third victim, who like the others was a minor allegedly victimized between 2010 and 2016. Three charges were brought in the case of the latest victim, and an additional charge added to one of the other two additional victims, totaling seven charges for the three victims, according to Javier Vaca of the prosecutor’s office.

Vaca said the additional charges and victim came to light during the discovery process. He declined to go into details on the newly identified victim, saying it was inappropriate to get into the facts of the case at this stage.

In addition to the filing of added charges, Vaca filed and received a criminal protection order against Kilgore prohibiting contacting the victims at any point. Kilgore remains in jail under a $1 million bail, which has not been met. If convicted, he faces sentencing of 15 years to life, said Vaca.

Kilgore is being charged on at least two violations of the penal code, 288.5 which is engaging in “three or more acts of substantial sexual conduct with a child under the age of 14 years at the time of the commission of the offense,” or lewd and lascivious conduct under similar terms. The broader charge of 288(a) is also being applied.

Outside the courtroom, Vaca could not say if more charges were pending in the case. “It’s still under investigation,” he said.

Kilgore returns to court on Thursday, Nov. 3. He previously appeared on Oct. 4 and again on Oct. 12, each time gaining a continuance as the case against him continues to unfold.
